This policy forms part of and organizes the restrictions in the Terms of Service. Capitalized terms have the meanings given in those Terms.
1. Lawful use
You must not use the Services for any unlawful, deceptive, or fraudulent purpose, or to promote goods or services prohibited by applicable law or by the policies of a connected Platform.
You are responsible for your relationship with End Users, including your own terms, privacy notices, and legally required disclosures.
2. Messaging and consent
When contacting End Users by email, SMS, WhatsApp, chat, or another channel, you must comply with applicable marketing, privacy, and electronic communication laws, including GDPR and ePrivacy rules, CNIL guidance where you serve customers in France, CAN-SPAM, TCPA, and CASL, as applicable.
You must:
- Obtain and be able to demonstrate any required consent before initiating marketing communications.
- Honor opt-out and unsubscribe requests promptly.
- Respect Platform messaging windows and template rules, including those of WhatsApp Business Platform.
- Refrain from unsolicited bulk messages, spam, and deceptive messages.
- Preserve disclosures required when an End User interacts with an automated system.
3. Prohibited conduct
You must not:
- Upload or transmit infringing, defamatory, malicious, or malware-containing content.
- Interfere with or disrupt the integrity, security, or performance of the Services.
- Attempt to gain unauthorized access to the Services or related systems.
- Reverse engineer, decompile, or copy the Services except as permitted by law.
- Scrape or harvest data outside documented APIs.
- Resell or provide the Services to third parties unless expressly permitted.
- Use the Services to build a competing product.
- Circumvent usage limits, security measures, or Platform rules.
You must not permit Authorized Users or End Users to engage in prohibited conduct through your account.
4. Merchant Data
You are responsible for the accuracy and lawfulness of Merchant Data, for providing legally required notices, and for obtaining the consents needed for Leafine to process Merchant Data on your behalf.
You must not submit personal data obtained or used without a lawful basis, or content that violates third-party rights.
5. Enforcement
We may investigate suspected violations and may throttle, limit, suspend, block, or terminate activity that we reasonably believe violates this policy, the Terms, applicable law, or a Platform's policies.
Where practicable, we will provide notice. We may act without advance notice where necessary to address a security, legal, reputational, or Platform risk, or where required by law or a Platform.
